General Terms and Conditions
1. General
The purchase contract(s) is/are concluded between you and the seller of the items you ordered; the respective seller of an item is displayed at various points in the ordering process, in particular on the item details page, in the shopping cart and before completing the order (“Seller: XY”). The seller of an item is either us (Modabout (GmbH & Co KG)) (hereinafter “Modabout items”) or another seller (hereinafter “items from other sellers” or “items from another seller”).
2. Time of conclusion of the contract:
The presentation of the goods and services on Modabout.de does not constitute a legally binding offer, but rather general information. By clicking on the button “Order now at the stated price” you make a binding offer to purchase the goods contained in the shopping cart. Immediately after completing the ordering process, you will receive an order confirmation by email. If you pay in advance or via PayPal, the purchase contract is concluded when you receive the order confirmation. For all other payment methods, the purchase contract is concluded as soon as you receive our shipping notification or shipping confirmation sent by email; at the latest, however, when you receive the goods.
3. Cancellation policy
Right of cancellation
You have the right to cancel the contract with us or another seller within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you can - regardless of whether it is a Modabout article or an article from another seller - inform us (Modabout (GmbH & Co KG), Peiner str. 33 salzgitter, 38229 Germany, Tel.: +49 176 63441874, email address: reset-fashion@outlook.de) by means of a clear statement (e.g. an email) of your decision to withdraw from the contract. You can use the attached sample withdrawal form for this purpose, but this is not mandatory.
To meet the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of cancellation
If you cancel the contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered), promptly and at the latest within fourteen days from the day on which we received your cancellation of the contract. For this refund, the same means of payment will be used that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. Unless collection of the goods was offered, the refund may be refused until the goods have been received back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return the goods to the return address of the respective seller promptly and in any event no later than fourteen days from the date on which you notified us of the cancellation of the contract, unless it was offered that the corresponding goods would be collected from you. The deadline is met if you send the goods before the expiry of the fourteen-day period. Details and instructions for a quick and uncomplicated return of the goods can be found under My Account. Here you can access your return label for many items and, in the case of freight forwarding, view the contact details of the freight forwarder.
The respective seller bears the costs for returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties and functioning. If you have requested that services for which payment is required should begin before the expiry of the cancellation period, you must pay an appropriate amount that corresponds to the proportion of the services already provided up to the time of cancellation compared to the total scope of the services provided for in the contract.

4. Non-existence of the right of withdrawal: According to Section 312g Paragraph 2 of the German Civil Code (BGB), there is no right of withdrawal for contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
The right of withdrawal expires prematurely for contracts for the delivery of
sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery,
of sound or video recordings or computer software in a sealed package if the seal was removed after delivery.
5. Voluntary right of return: In addition to the statutory right of withdrawal, you have a voluntary right of return of a total of 14 days for all goods purchased on the marketplace. You can also withdraw from the contract after the 14-day cancellation period has expired by registering the goods for return under My Account within 14 days of receipt (the period begins on the day after receipt of the goods) and sending them back to the return address of the respective seller (to meet the deadline, it is sufficient to send the goods in good time). In the case of freight forwarding goods, the freight forwarding goods can be picked up within the 14-day return period instead of returning them to the respective seller. For a Modabout item, registering for return under My Account is not mandatory - unlike items from another seller - in order to effectively exercise the voluntary right of return.
If the goods are not complete and in an intact and undamaged condition, compensation can be demanded for any loss of value that has occurred, provided that the loss of value is due to handling of the goods that was not necessary to check the quality, properties and functioning of the goods.
The voluntary right of return does not apply to contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
The voluntary right of return expires prematurely in the case of contracts for the delivery of
sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery,
of sound or video recordings or computer software in a sealed package if the seal was removed after delivery.
The voluntary right of return also does not apply to mixed contracts for the delivery of goods and the provision of services with regard to the services included in the mixed contract.
Until the deadline for the statutory right of withdrawal expires, only the statutory conditions listed there apply. The contractually granted voluntary right of return does not affect your statutory rights and claims, the use of which is free of charge. In particular, your statutory right of withdrawal and your statutory warranty rights remain unaffected.
6. Deliveries are generally only possible within Germany, excluding the postcodes 72866 Büsingen and 27498 Helgoland. Items sold by us are mostly delivered by Hermes or DHL. Other sellers on Modabout.de may use other transport companies. Items are only delivered in normal household quantities.
7. If items delivered have obvious material or manufacturing defects, including transport damage, please complain about such defects immediately to us or to the employee of the shipping service provider who delivers the items. Failure to do so, however, has no consequences for your legal claims. You are entitled to the statutory warranty rights for defects for all items purchased on Modabout.de.
8. Contact: If you have any questions or problems in connection with a Modabout item, please feel free to contact us. If you have any questions about an item from another seller, please submit your request using the "Contact seller" button under My account > My orders.
9. Validity of prices: The prices stated on Modabout.de are Euro prices (including statutory tax).
10. Delivery and shipping costs: When ordering items from different sellers, you will generally receive multiple deliveries. The shipping method (package or shipping company) and the delivery conditions (for shipping by shipping company) are part of the item information on the item details page. The respective shipping costs of your order are broken down in the shopping cart and in the overview before clicking the button "Order now at the stated price".
11. Payment: In order to be able to offer you an attractive range of payment methods on Modabout.de, we cooperate with our payment service provider, Modabout Payments GmbH,

Modabout Payments handles payment processing for all purchases on Modabout.de.
You can generally pay in advance, by direct debit, on account, by installment or PayPal.
As part of the payment processing by Modabout Payments, the seller's payment claim against you is assigned to Modabout Payments. As part of your order, you consent to the transfer of your personal data and that of the order to Modabout Payments for the purpose of identity and credit checks, as well as contract processing.

Direct debits are collected by the payment service provider Hanseatic Bank GmbH & Co KG, Fuhlsbüttler Straße 437, 22309 Hamburg.
We reserve the right to only offer you certain payment methods. There is no possibility of deducting a discount.
In individual cases, we reserve the right to only deliver the goods after a down payment. After receipt of the order, we will coordinate this with you.

12. Retention of title: The goods remain the property of the respective seller until full payment has been made.
13. Alternative dispute resolution: The EU Commission offers the possibility of online dispute resolution on an online platform operated by it. This platform can be reached via the external link https://ec.europa.eu/consumers/odr/. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board. The same applies to the other sellers.
14. Contract language/storage of the order text: The contract is concluded in German. We do not save the contract text after the contract has been concluded. The details of your order will be made available to you in the order confirmation sent by email. The order confirmation also contains these general terms and conditions.
